Error on your property title register in England or Wales?
Title register errors at HM Land Registry arise for many reasons — administrative mistakes, errors introduced during conveyancing, changes in personal circumstances not updated on the register, and historic discrepancies carried forward from original registration. Common errors include:
A title register error that appears minor can become a significant problem when you come to sell or remortgage in England and Wales. Solicitors acting for buyers and lenders carry out title investigations and will raise requisitions where they identify discrepancies. Depending on the nature of the error it may need to be resolved before the transaction can proceed — causing delays and in some cases transaction failures. Correcting title register errors early, before a transaction is imminent, is always preferable.
A name change following marriage, civil partnership, divorce or deed poll does not automatically update your Land Registry title register in England and Wales. The name on your title will remain as it was when the property was registered. Lenders will sometimes require the name on the title to match the name on the mortgage before a remortgage can proceed. Call and a specialist will handle the update.
