Common Title Register Errors in England and Wales

Title register errors at HM Land Registry arise for many reasons — administrative mistakes, errors introduced during conveyancing, changes in personal circumstances not updated on the register, and historic discrepancies carried forward from original registration. Common errors include:

Why Title Register Errors Matter

A title register error that appears minor can become a significant problem when you come to sell or remortgage in England and Wales. Solicitors acting for buyers and lenders carry out title investigations and will raise requisitions where they identify discrepancies. Depending on the nature of the error it may need to be resolved before the transaction can proceed — causing delays and in some cases transaction failures. Correcting title register errors early, before a transaction is imminent, is always preferable.

Updating Your Name on the Title Register

A name change following marriage, civil partnership, divorce or deed poll does not automatically update your Land Registry title register in England and Wales. The name on your title will remain as it was when the property was registered. Lenders will sometimes require the name on the title to match the name on the mortgage before a remortgage can proceed. Call and a specialist will handle the update.

Frequently Asked Questions

Does an error on my title affect my legal ownership?
Not necessarily. A name spelling error or minor discrepancy does not invalidate your ownership but can create practical difficulties with transactions. Call and we will advise on whether and how urgently your specific error needs to be corrected.
What if Land Registry made the error?
Land Registry can be asked to correct errors they made without charge. Your solicitor will write to Land Registry with evidence of the error and request correction. Land Registry's indemnity scheme also covers losses caused by their errors in some circumstances.
How long does a title register correction take?
Simple corrections such as name changes can be processed by Land Registry within weeks. More complex corrections involving boundary disputes or adverse claims can take considerably longer. Call for a realistic timeline for your specific correction.
