If you are selling a property in England and Wales with a Form LL restriction on the title register, a Certificate of Compliance from an independent solicitor is required before the sale can be registered at Land Registry. Does a Form LL Restriction Prevent Me Selling?

No. The restriction does not prevent the sale. It requires one additional document — the Certificate of Compliance — to be included with the Land Registry registration application. Once the certificate is in place, the sale proceeds normally.

Who Obtains the Certificate on a Sale?

The Certificate of Compliance is obtained by the seller, not the buyer. Your sale solicitor will advise you that it is needed but cannot obtain it themselves — they are acting on the transaction and therefore cannot be the independent certifier. FormLL connects you with an independent specialist.

Timing on a Property Sale

Obtain the certificate before exchange of contracts. The buyer's solicitor will require it — or at least confirmation it will be provided — before recommending their client exchanges. Leaving it until the week before completion risks delays.

Joint Names on the Title

If the property is owned jointly, all legal owners named on the title must attend the same video call. Both owners must be available at the same time. If one owner is based overseas, the call can still be conducted remotely from anywhere in the world.
