When you gift a property or a share in it, HM Land Registry registers a transfer. Anyone party to that transfer who is not represented by a conveyancer needs their identity verified, usually on form ID1, which a solicitor can do by video with ID5. If the title has a Form LL restriction, the gift is a disposition by the owner, so a conveyancer's Form LL certificate is also needed.
Checklist
| Item | Needed when |
|---|---|
| ID1 (+ ID5 if by video) for each person giving | They are not represented by a conveyancer |
| ID1 for each person receiving | They are not represented by a conveyancer |
| Form LL certificate | The title has a Form LL restriction |
| Lender consent | There is a mortgage on the property |
Beyond the Land Registry forms
Gifts of property can have tax consequences, including for inheritance tax and capital gains tax, and stamp duty land tax can apply if a mortgage is taken over. This page covers HM Land Registry's identity and restriction steps only. Take tax advice before transferring.
Keep the three-month window
Have identities verified once the transfer deed is agreed. ID forms must be dated within three months of the application to HM Land Registry.
Book: ID1 + ID5 by video, £100 inc VAT per person.

Does everyone need an ID1 when gifting a house?
Each party who is not represented by a conveyancer does, unless an exception in Practice Guide 67 applies or the land is worth £6,000 or less.
Can family members verify each other's identity?
No. ID1 must be verified by a conveyancer, Chartered Legal Executive or other approved verifier.
