Land Registry forms explained

RX3 or RX4: which form removes Form LL?

Two HM Land Registry forms can take a restriction off the register. For Form LL, the choice matters less than the certificate that has to go with it.

Short answer

RX3 is the application to cancel a restriction; RX4 is the application to withdraw one, made by the person with the benefit of the restriction or with their consent. Form LL removals are commonly made on RX3, and Answers on HM Land Registry's support forum confirm that RX3 plus a conveyancer's certificate complying with the restriction wording is the route for an owner removing Form LL. Whichever form is used, the certificate is required.

Why the certificate is always needed

A Form LL restriction says no disposition by the proprietor is to be registered without a certificate signed by a conveyancer that they are satisfied the person who executed the document is the same person as the proprietor. An application to remove the restriction is itself a risk point: a fraudster who could remove the restriction could then sell or mortgage the property. So HM Land Registry looks for the same assurance before cancelling it.

The certificate must be signed by an individually regulated conveyancer personally, not in the name of their firm, and HM Land Registry's Practice Guide 19 makes clear a wet-ink signature is required. Form RXC can be used to provide the certificate.

Joint owners

Where two people own the property, one application can cover the title, but each owner needs to be verified, and the certificate (or certificates) must cover both. Answers on HM Land Registry's support forum describe this as one application completed by both owners plus the required certificate or certificates.

Common mistakes that cause requisitions

Each of these leads HM Land Registry to raise a requisition — a request for more information — which adds weeks. The FormLL removal service handles the form choice, the certificate and the lodging together.

Frequently asked questions

Can I use RX4 to remove a Form LL I applied for myself?

Possibly, depending on the restriction wording and who it benefits, but answers on HM Land Registry's support forum have advised owners to use RX3 with a conveyancer's certificate. The solicitor checks your title and uses the correct form.

Can I vary a Form LL restriction on RX2?

No. Form LL is a standard form of restriction, so it cannot be varied. It is either complied with or removed.

Is RXC the same as the certificate?

RXC is a Land Registry form that can be used to provide consents or certificates required by a restriction, including a Form LL certificate. It is not a standalone application.
